Trump moves to strip illegal immigrants from census count

A new federal proposal would exclude undocumented residents from the 2030 apportionment count — reshuffling congressional seats and triggering immediate legal threats.

Driving the news: The Trump administration published a proposal Wednesday in the Federal Register to exclude illegal immigrants and non-green-card holders from the census apportionment count after 2030.

The plan would also strip race, ethnicity, and sexual orientation questions from the census. The administration cited a 'reduced need for or usefulness of this information.'

Why it matters: Apportionment determines how many House seats each state gets. The stakes are enormous. States with large undocumented populations — California (2.3 million), Texas (2.1 million), Florida (1.6 million), New York (825,000), New Jersey (600,000), and Illinois (550,000) — stand to lose the most representation, according to a Pew Research study based on 2023 data.

The legal fight starts now: New York Attorney General Letitia James said Wednesday her office is already 'exploring' legal options. Critics point to the 14th Amendment, which requires counting 'the whole number of persons in each State.'

Between the lines: Trump signaled this move in an August 2025 Truth Social post. He directed the Commerce Department to build a new census using 'modern day facts and figures.' He was explicit: 'People who are in our Country illegally WILL NOT BE COUNTED IN THE CENSUS.'

The bottom line: For years, illegal immigration quietly inflated blue-state seat counts at taxpayers' and legal residents' expense. This proposal corrects that distortion. Courts will decide the constitutional question — but the political logic is straightforward: representation should follow citizenship, not border evasion.
